Mission Statement
The Fayette County DUI/Drug Court mission is to identify and educate those with addictions through accountability and treatment to strengthen our community in a collaborative court setting.

Goals & Objectives

Goal I: Promote long term recovery of participants

Objectives: Provide community based therapeutic treatment and other supportive services based on the individualized needs of each participant supported through a comprehensive program of supervision, monitoring, and other elements such as rewards and sanctions.

 

Goal II: Reduce Cost

Objectives: Provide an alternative to long-term incarceration for offenders who match the eligibility criteria and reduce the substantial costs associated with that incarceration. In choosing this alternative we will save taxpayer dollars and court and prison costs will be decreased as well as lightening the burden on the criminal justice system to handle violent and other serious cases.

 

Goal III: Provide a means to achieve productive community involvement and responsible citizenship.

Objectives: The program provide will provide a platform that facilitates healthy and positive interactions with law enforcement and the criminal justice system. Participants will be required to complete community service work, job trainings, maintain fulltime employment, and actively participate in community giveback projects.

Goal IV: Reduce and eliminate the use of alcohol and controlled substances while decreasing the recidivism rate.

Objectives: Mandate intensive substance abuse treatment and close judicial supervision and mentoring of all participants. Frequent, random, observed testing will be performed as well as intensive supervision with curfew checks and field visits. Impose immediate sanctions for non-compliance as well as positive reinforcement and rapid response to success. Focus on rehabilitation and recovery while requiring personal accountability to break the cycle of addiction.

 

To be eligible for consideration, applicants must:

  • First DUI conviction in five years, second DUI conviction in seven years

  • First DUI conviction in five years, third lifetime conviction or more

  • Second DUI conviction in five years, second lifetime conviction or more

  • Third DUI conviction in five years, third lifetime conviction or more

  • Fayette County resident at the time of sentencing

  • At least 17 years of age

  • Admission of a problem and a desire for treatment and recovery

Benefits of the program include:

  • a reduction of fine(s), conditioned upon successful completion of the program;

  • may be eligible in a reduction in community service hours based on program compliance and sentence

  • affordable treatment and alcohol/drug testing;

  • supervision in meeting license reinstatement requirements; and support in achieving sobriety.

 

Cost

The cost of the program is $80 per week while in the program. Program fees include, treatment, probation supervision and drug screening.

 

Phases

DUI/Drug Court is divided into 2 tracks with 4 phases per track.

 

Early Intervention Track: focuses on building skills essential to early detection and prevention. Moderate risk.

 

Dependency Track: focuses on cognitive behavioral therapy to reduce recidivism and lower risk factors while addressing

criminal addictive behaviors and substance use disorders.

DUI/Drug Court is a minimum 15-months program consisting of 4 Phases:

Phase 1: Acclimation and Early Recovery Phase (minimum of 4 months)

Phase 2: Transitional/Action Phase (minimum of 4 months)

Phase 3: Maintenance Phase (minimum of 4 months)

Phase 4: Aftercare (minimum of 3 months)

Court

Phases 1 & 2 are required to attend court a minimum of twice per month

Phases 3 & 4 are required to attend the first court session of the month.
